Voges v Monaghan [1954] HCA 63

The majority held that, giving proper weight to the trial judge's credibility findings and the documentary and oral evidence, it was open to find that the testator communicated binding wishes that each respondent receive three pounds per week for life, that the appellant acquiesced in or undertook to carry out those wishes, and that the testator made or left his will in reliance on that undertaking. Accordingly the appellant held the estate subject to the secret trusts, and the appeal was dismissed subject only to variation of the form of the declaration.
