R v Haralabidis, Lazaros and Petropoulos, Timotheos [2010] NSWDC 175

R v Haralabidis, Lazaros and Petropoulos, Timotheos [2010] NSWDC 175

Both accused were found guilty of serious aggravated sexual assault offences without consent, in circumstances of aggravation (in company) against a 17-year-old complainant. The offences required condign punishment. While certain counts fell within the mid-range seriousness qualifying for standard non-parole periods, special circumstances, including youth and lack of full appreciation of the consequences, justified imposing non-parole periods less than the statutory standard. Sentences were set to reflect both objective criminality and subjective mitigation, with concurrent sentencing for offences committed as a continuous course of conduct within the car.
