The Court found the offence was towards the mid-range of objective seriousness because the Offender, a hospital wardsman assisting an elderly and physically vulnerable patient to shower, inserted his finger into her anus knowing she did not consent in circumstances where she could not protect herself. Although the penetration lasted only a couple of seconds and the offending was opportunistic, general deterrence, adequate punishment, retribution and specific deterrence required full-time imprisonment.
