Although the Council had succeeded on a limitation defence and the plaintiffs' recovery of $3,050.00 plus interest and half of Lot 31 would not itself justify depriving the Council of costs, the Council had sold the plaintiffs' land when it had no right to do so and thereby created a very unclear title situation affecting the plaintiffs and the second defendant. Because that real problem was created by the Council's wrongful conduct and required determination by the Court, the Council should pay the plaintiffs' costs apart from specified costs and indemnify the plaintiffs for the second defendant's costs ordered against them.
