Mr Sloane had failed to comply with his Drug Court program by failing to attend after 27 August and by being charged with armed robbery offences involving the production of a firearm, which involved violent conduct within s5(2)(b). Although breach alone was insufficient, the Court was satisfied that no useful purpose would be served by further participation because the alleged conduct was serious criminal behaviour not shown to require Drug Court intervention for drug dependency, and protection of the community was not being served by continuation.
