The trial judge erred in law by failing to apply the correct statutory criterion for determining whether the worker's incapacity resulted from injury received before or both before and after the commencement of the 1987 Act, as required by the transitional provisions. Alternatively, the judge's failure to adequately articulate reasons for the application of the 1926 Act was also an error of law.
