Wong v Novakovic [2022] NSWSC 1072

Wong v Novakovic [2022] NSWSC 1072

The Loan Agreement and Second Mortgage were not unjust in the circumstances at the time they were made. Mrs Novakovic had the opportunity to read and understand the documents, received legal advice and benefited from the transaction. Any pressure or intimidation she felt arose from her relationship with her husband, not Mr Wong, who did not exploit the situation. As such, Mr Wong was entitled to possession of the property, and Mrs Novakovic's cross claim failed.
