HIH Casualty [2002] NSWSC 1036

The Supreme Court has discretion to approve, retrospectively, the entry by liquidators into agreements for services under s.477(2B) Corporations Act 2001 (Cth), where those agreements are necessary for the conduct of the liquidation and where public policy supports effective administration. Prior approval is preferable, but absence of such approval does not render the contracts invalid.
