Re A Practitioner [2010] NSWMT 18

The practitioner was entitled to a Schedule 1 inquiry before the Registration Committee refused general registration because the Board was not satisfied as to eligibility. The Council's contrary interpretation of clauses 9 and 10 was wrong. On the second appeal, the agreed conditions were substantially different from the original conditions in both practical and literal terms, including reduced supervision and reporting requirements and removal of the three-practitioner requirement. The practitioner therefore succeeded on her appeal and the respondent was ordered to pay the appellant's costs of each appeal.
