The warrants were validly issued under s 3E of the Crimes Act 1914 (Cth). Section 22 of the Australian Crime Commission Act 2002 (Cth) was not an exclusive code preventing use of Pt 1AA, and Pt 1AA contains no limitation preventing a warrant from being issued solely to assist an ACC special investigation where the statutory requirements are satisfied. Section 3D(2) confirmed that Pt 1AA powers may be used despite the availability of a similar Commonwealth search warrant power under s 22 of the ACC Act.
