The lessee was not entitled to abate rent either under the lease or s 36 of the Retail Leases Act 1994 (NSW), as the preconditions for abatement were not satisfied. The lease was validly terminated for non-payment of rent, and the lessee remained in wrongful possession. The claim for damages in respect of rent paid under other premises also failed.
