Because the Workers Compensation Commission had conclusively determined the plaintiff's liability by finding a compensable workplace injury, and because the plaintiff did not pursue the available statutory review or appeal mechanisms, the plaintiff could not use Local Court enforcement proceedings under s 145(6) to re-litigate liability, the existence of a workplace injury, or whether a debt existed. The cross-claim was also impermissible because it necessarily impugned Commission findings that were no longer open to appeal. The Local Court was therefore correct to dismiss the defence and cross-claim, and the appeal was dismissed.
