Detective Sergeant Harkins is qualified by his training, study and experience in both bloodstain pattern analysis and crime scene analysis to give the challenged opinion evidence. The judge is not bound by the prior procedural order as it would not serve the interests of justice to be constrained by it for the current trial. The further expert evidence is admissible under s 79 of the Evidence Act 1995 (NSW) and is not excluded under ss 135 or 137 as there is no identified prejudice to the accused and the jury can properly assess its weight.
