Procedural Posture

Civil Procedure; Non Publication Order Application / Duty Judge Application to Preserve the Plaintiff's Position Pending Proposed Application for Leave to Appeal

  1. 1 ['Whether judgments in Kostov v YPOL Pty Limited should be removed from Caselaw and not published for a short period pending a proposed application for leave to appeal against refusal to continue a non-publication order.' "Whether the plaintiff's medical evidence and risk of harm justified preserving her position despite the open justice interest in publication."]

Ratio Decidendi

There was sufficient doubt about the conclusion that the plaintiff's identifying details should be published, in light of psychiatric evidence concerning bipolar disorder and risk of harm, to justify preserving the plaintiff's position pending any application for leave to appeal. Because the interest sought to be protected was the non-disclosure of the judgments themselves, a short-term order removing all judgments in the proceedings from Caselaw was appropriate until 18 October 2017 or further order of the Court of Appeal.

Court Disposition

Application granted in part by temporary non-publication order.
