AEI established a prima facie case that, soon after resigning and joining a competitor, Mr Martin directly or indirectly approached or dealt with AEI clients with whom he had dealt while employed by AEI and used confidential client contacts and client lists obtained in that employment, contrary to clauses 12(c) and 13.2(a) and (b) of his employment contract. The balance of convenience favoured AEI because it had already lost client business and further loss could continue, damages would be inadequate given the nature of the obligations and loss, and the orders would principally restrain Mr Martin from doing what his contract already prohibited.
