The respondent made fraudulent representations in relation to claims for total disablement benefits after February 2016 while being capable of and in fact performing work overseas. The applicant was entitled to refuse payment pursuant to s 56(1) of the Insurance Contracts Act 1984 (Cth), to cancel/terminate the contract, and to recover damages, including policy payments and investigation costs, with costs awarded on an indemnity basis.
