Horton v Padoani [2023] NSWDC 447
The plaintiffs did not establish that the defendant instituted or maintained the prosecution. The Court found that the prosecution was initiated and maintained by Police in the conventional manner, after Police had the defendant's complaint, CCTV footage objectively corroborating the substance of the incidents, and medical reports corroborating ear pain or minor acoustic trauma. The plaintiffs did not prove that the defendant knowingly gave a false complaint or withheld relevant CCTV footage, and the evidence showed Police retained discretion in deciding to prosecute. The plaintiffs also failed to establish malice or absence of reasonable and probable cause.
