Although the applicant failed to provide requested information on solar access before or during the hearing, the council could not specify any legal costs incurred as a result of that failure. The council's costs in defending the appeal were therefore the same as they would have been if the applicant had provided the information, so it was not fair and reasonable to award costs against the applicant.
