Procedural Posture

Criminal Severity Appeal Against Sentence for Dangerous Driving Occasioning Grievous Bodily Harm / District Court Appeal From Local Court Sentence; Rehearing and Decision on Appeal

  1. 1 ['Whether the sentence of 1 year full-time imprisonment with a non-parole period of 7 months was excessive.' "Whether the appellant's dangerous driving involved objective seriousness and moral culpability requiring full-time imprisonment." 'Whether any lesser sentence, including an intensive correction order or other non-full-time custodial sentence, was appropriate.']

Ratio Decidendi

The appeal was dismissed because the appellant drove too fast for the corner and conditions, failed to maintain proper control and was significantly in the wrong lane when she collided with the cyclist. Her moral culpability was below mid-range but more serious than momentary inattention, the injuries were extremely serious, and the overall objective gravity was lower than mid-range but well above the lowest range. Despite her remorse, prior good record, support, mental health issues and rehabilitation prospects, only full-time imprisonment adequately reflected the seriousness of the offending and no lesser sentence was appropriate.
