R v Whyte did not make a meaningful change to the numerical guideline in R v Jurisic for this case, and the guideline did not cease to be relevant merely because one or more features of a frequently recurring case was absent. The serious aggravating features, including escaping police pursuit, excessive speed, running red lights and driving only on a learner's permit without an authorised licence holder, justified the sentence after allowance for the applicant's injuries, remorse, plea of guilty and other mitigating matters.
