The court held that the Bankruptcy Act 1966 (Cth) contemplates service of a bankruptcy notice out of Australia, subject to leave where actual service occurs outside Australia, but substituted service made within Australia, in accordance with court order and where the creditor is unaware of the debtor's absence, is valid without such leave. Thus, the order for substituted service made when the debtor was out of Australia was properly made and effective.
