Interlocutory injunctive relief was refused because the respondent's round, open mesh hayfeeder was visually too different from the applicant's octagonal, solid-sided registered design, and the respondent's upright post, with splayed legs, square tubing and angular dog-leg bends, was not an obvious imitation of the applicant's curved, parallel-sided post. On the evidence, the differences were adopted for economic and functional reasons rather than merely to disguise copying, so fraudulent imitation was not shown and there was no serious question to be tried.
