Section 37(4) of the Workers Compensation Act 1987 required proof of actual total or main dependency, and on the evidence the child Nykita was mainly, though not totally, dependent on the applicant because the applicant's compensation income and expenditure made a substantial contribution to household support and the withdrawal of either parent's income would have been catastrophic to the household finances and to the support provided to the child.
