Procedural Posture

Workers Compensation Claim / Principal Judgment After Hearing

  1. 1 ["Whether the plaintiff's neck condition and incapacity were caused by the workplace incident on 31 March 2014 rather than only by pre-existing cervical spondylosis." 'Whether the plaintiff was totally incapacitated for work from 16 December 2014.' "Whether the defendant was liable to pay the plaintiff's hospital, medical and like expenses pursuant to s60, including expenses associated with proposed cervical surgery."]

Accordingly, the plaintiff was entitled to weekly compensation for total incapacity and to hospital, medical and like expenses pursuant to s60.

Court Disposition

Award for the plaintiff for weekly compensation for total incapacity, s60 expenses, and costs.
