Section 75(1) of the Environmental Protection and Biodiversity Conservation Act 1990 (Cth) requires the Minister to make a decision as to whether a proposed action is a controlled action, but does not require the existence of an independently and objectively determined jurisdictional fact that there will be a significant impact. The decision is properly left to the Minister's determination. Further, it was not an error of law for the Minister’s delegate to refer to privately maintained ecological classifications in considering whether an area fell within a listed threatened ecological community.
