Because the realised assets were trust assets, the Company's business was limited to acting as trustee of The Lee Family Trust, the Company's liabilities were incurred as trustee, the Company was entitled to indemnification from trust assets, and the liquidator's costs, expenses and remuneration were recoverable from those assets, it was just and convenient and in creditors' interests to appoint the liquidator, nunc pro tunc and without security, as receiver of the trust assets with the powers sought.
