Although a branch had failed onto the applicant's house, it did not cause damage substantial enough to warrant an order removing the tree, the tree was not currently causing damage, and the risk of whole tree failure was remote because there was no evidence of instability at the base or obvious structural defects in the trunk or main structural branches. However, considerable dead wood of a size that could cause damage or injury justified an order for pruning.
