Although the SEPP 1 objections to the identified departures from the special development standards were found to be well founded, the proposed residential flat development was not of good design under SEPP 65 because it failed to respond positively to its context, scale, built form and density, was visually overwhelming in relation to Newlands Park and nearby low density residential areas, would adversely impact the natural and built environments of the locality, and the site was unsuitable for the proposed development. The appeal was therefore dismissed and development consent refused.
