Australian Competition and Consumer Commission v Nuera Health Pty Ltd (In Liquidation) ABN 97 113 678 452 [2007] FCA 695

The Court held, in the absence of any defence or contradictory evidence from the respondents, that the ACCC had established, on substantial affidavit evidence, that the respondents had engaged in systemic and deliberate misleading or deceptive conduct, made false or misleading representations regarding cancer cures and related matters, and had exploited vulnerable cancer patients with unconscionable practices, thereby contravening sections 51AB(1), 52, 53(a), 53(aa), 53(c), 53(f) and 55A of the Trade Practices Act 1974 (Cth). The Court was satisfied that individual respondents (Paul Rana, Christopher Rana, Micheal Rana) were knowingly involved in the corporate respondents' unlawful conduct.
