The transcript of Mr Chatfield's examination was not prepared by an officer of ASIC because it was produced by ComputerReporters and signed by Mr Chatfield, not physically prepared or drawn up by ASIC. However, after inspecting the transcript, the Court found that it did not support Citigroup's case or impeach ASIC's case, and at most suggested possible lines of inquiry. It therefore did not tend to establish Citigroup's case within s 12HB, so ASIC was not required to produce it under s 12HB(2).
