The fixture was vacated and the proceedings adjourned because the medical evidence, although not establishing a clear final diagnosis or incapacity, cast sufficient doubt on the third defendant's mental state and capacity to conduct the proceedings that it would not be fair to proceed in a manner requiring his participation. In light of the same developments, fairness also required not proceeding against the fourth defendant alone. Temporary injunctive relief against the third defendant was justified by the public interest, the seriousness of the allegations and the adjournment, but not on the basis of a sufficient prima facie case of mental incapacity to act as a director.
