Having regard to the seriousness, scale, and duration of contraventions, and their impact upon consumers, and applying statutory and case law factors, the Court determined that appropriate penalties would have been $600,000 for R2O's Code contraventions (if it remained in liquidation), $175,000 for R2O's ASIC Act contraventions, $138,000 for Mr Green and $90,000 for Mr Roberts for knowing concern in 133 ASIC Act contract contraventions, and a three-year injunction is appropriate against the individuals to secure compliance and deterrence.
