Australian Securities Commission v Solomon, Emad Kamel & Ors [1996] FCA 28
Given the demonstrated deficiency in assets, lack of proper records, intermingling of funds, conflict of interest, and risk to the interests of creditors and the public, and in the absence of substantial evidence to the contrary, it is essential and appropriate that a provisional liquidator be appointed to the three corporate respondents immediately under s472(2) and s461(h) of the Corporations Law.
