Kurzyp v Kurzyp [2021] NSWSC 851
The wife contributed at least half the purchase price of the Liverpool property through funds from her 'A' account and her father's gift. With the property placed solely in husband's name, and the parties in a de facto relationship, a resulting trust arises for the wife as to a one-half share. The defence of laches is not established as there is no evidence of unconscionable prejudice. No estoppel applies; prior proceedings were withdrawn without determination and the Polish courts had no jurisdiction over the Australian property. The wife is entitled to an account for unpaid rent and an order for statutory sale and costs.
