Alford & Young v Bellingen Shire Council [2008] NSWLEC 1210
Development consent was warranted for a modified roofed balcony because, with the floor plate and roof lowered, a 2 m balcony with eaves aligned to the floor plate was consistent with the streetscape rhythm, did not cause unacceptable solar impact, adequately addressed stormwater by tank drainage, and could address privacy impacts through obscure glazed screening for the full width of the balcony. The proposed 2.75 m projection and 700 mm eave extension were not shown to be necessary or desirable.
