The plaintiffs failed to establish on the balance of probabilities that the defendant guaranteed or otherwise accepted personal liability for fees not paid by the clients, and did not comply with the statutory prerequisites for recovery of legal costs. There was insufficient or unreliable evidence of a binding guarantee, representation, or agency, and the claims concerning payment of legal or accounting fees by the defendant cannot succeed.
