Siemens WLL v BIC Contracting LLC (stay) [2023] FCA 1669
A stay was justified only for a shorter period. Although the applicants could suffer loss if no stay were granted and they later succeeded on appeal, a stay could cause further commercial harm to the garnishee, CIMIC and SALD, and the garnishee had already been restrained for about three months by a garnishee order found to be beyond the Court's reach and inappropriate. Balancing those matters, the Court was not satisfied that a stay until 29 January 2024 was justified, but granted a stay until 5:00pm on 5 January 2024 to allow the applicants time to consider their position.
