Billgate Pty Ltd v Woollahra Municipal Council [2007] NSWLEC 399
The proposal did not comply with the 15 metre site frontage standard in clause 10B(1) of Woollahra Local Environmental Plan 1995, and objective 10A(a) applied to that frontage standard. Because the battle-axe configuration concentrated a three-dwelling residential flat building at the rear of the site, producing adverse impacts and incompatibility with the scale, density, bulk and landscape character of buildings and allotment size in its context, the SEPP 1 objection was not well founded and consent could not be granted.
