Ratio Decidendi

The parties objectively intended to be bound by a settlement reached before the security for costs motion was heard. The defendant's solicitors prepared the deed to record the settlement already reached, informed the Court without qualification that the whole proceedings had been settled, and later did not assert that there was no agreement or that the agreement was conditional on execution. The case therefore fell within the first class in Masters v Cameron, and execution of the deed was not required before the agreement had binding effect.
