Bluestone Property v North Sydney Council [2006] NSWLEC 449
The supermarket and fruit market were inconsistent with and antipathetic to the Residential D zone objectives and related character controls, and also drove excessive excavation. The height variation could be accepted only with amendments protecting the privacy of 7 and 8 Tarella Place. With the supermarket and fruit market removed, basement levels reduced, non-residential parking limited, and Building D amended as required, the amended proposal complied with the Court's findings and its impacts were reduced, so development consent should be granted.
