There is no common substratum of fact between the single federal claim and the various non-federal (common law) claims; therefore, accrued jurisdiction does not exist and the Federal Court cannot retain the proceeding. The Court will exercise its discretion to transfer the proceeding to the Supreme Court of Victoria under s 5(7) Jurisdiction of Courts (Cross-Vesting) Act 1987 (Cth), as there is no material prejudice to the parties.
