The appeal was dismissed because the evidence, including the applicant's admissions during the police walk-through, his plea of guilty, the sophisticated nature and scale of the cannabis cultivation, his link to proceeds of sale, and his ability to guide police and provide access, made it open to the sentencing judge to find beyond reasonable doubt that the applicant was a principal in the enterprise. The sentencing judge did not impermissibly adopt Local Court credibility findings or rely on the co-offender's sentence proceedings, and the applicant had no justifiable sense of grievance because the co-offender's culpability was found to be much lower.
