Ratio Decidendi

Because the plaintiff paid the whole purchase price without intending the defendant to acquire a beneficial interest, the defendant held his legal interest on resulting trust for her. However, after acquisition the plaintiff encouraged or acquiesced in the defendant undertaking work and occupying the property in reliance on a belief that he had a personal stake, making it unconscionable to deny him any share. His occupation did not cancel his entitlement, and laches was not made out. Equity was satisfied by giving the defendant an allowance equivalent to one quarter of the net sale proceeds, secured by an equitable charge, with sale of the property to be facilitated.
