Procedural Posture

Criminal Appeal / Judgment on Appeal

  1. 1 ['Whether the applicant was denied procedural fairness regarding the assessment of objective seriousness' 'Whether the sentencing judge erred in the assessment of objective seriousness for the supply charge' 'Whether the plea of guilty was entered late and affected the discount' 'Whether the sentence imposed was manifestly excessive']

Ratio Decidendi

The Court found that although the applicant was denied procedural fairness in not being forewarned of the judge’s finding as to objective seriousness, the aggregate sentence imposed was appropriate for offending of mid-range seriousness, and a combined discount greater than allowed would be unreasonably disproportionate. No less severe sentence was warranted and the appeal was dismissed.
