McGregor v State of Queensland [2009] NSWDC 69

McGregor v State of Queensland [2009] NSWDC 69

The court found that the alleged incident in which the plaintiff claimed to have fallen between the stretcher and the hospital bed did not occur. The evidence of the ambulance officers was accepted over that of the plaintiff, and there was no corroboration in hospital or ambulance records. The plaintiff's shoulder injuries were found to be pre-existing of long standing. Accordingly, the defendants were not negligent and not liable for the plaintiff’s injuries.
