The Court has both jurisdiction and power, under s.23 of the Federal Court of Australia Act, to grant interlocutory orders restraining execution of State court judgments against applicants where necessary to protect rights asserted under the Trade Practices Act, provided there is sufficient evidence of a prima facie case and risk of injustice if relief is not granted. Comity between courts is not breached by such an in personam order where the ultimate rights as to the sums in issue will be determined by the Federal Court proceeding.
