Brisbane City Council v Group Projects Pty Ltd [1979] HCA 54
Upon resumption by the Crown for school purposes, the land ceased to be subject to the Town Planning Act and Town Plan, as these did not bind the Crown. Consequently, the contractual obligations of Group Projects Pty Ltd under the deed, bond, and mortgage, all predicated on the possibility of developing the land, were discharged. The subsequent purported rezoning of Crown land was of no legal effect. The contract was frustrated due to the intervention of the resumption, which created a fundamentally different situation outside the contemplation of the parties at contract formation.
