Applying the Briginshaw standard, the Court was satisfied that the Defendant had $100,000 cash belonging to the Deceased, based on the 8 June 2005 and 10 April 2006 conversations, the accepted evidence of Mr Daley and Ms Webber, the Defendant's admissions, and her later inconsistent and implausible explanations. Her conduct in relation to that cash made it inappropriate for her to continue as executor, because a remaining task was distribution of the estate in accordance with the judgment and there was a substantial risk she would be reluctant to do so promptly and properly.
