The proposed Lots 11 and 12 did not have characteristics similar to the prevailing cadastral pattern of lots fronting Hercules Street and Beach Road. They were significantly smaller in area, different in shape, much shorter in depth, and inconsistent in orientation when compared with the prevailing rectangular, deeper lots in the immediate locality. Existing built form from the approved dual occupancy was not relevant to determining the prevailing cadastral pattern under Control C5. Because the subdivision failed to reflect or reinforce the predominant subdivision pattern required by the Marrickville Development Control Plan 2011, consent should be refused and the appeal dismissed.
