On the proper construction of the will, the whole net income of the residuary estate was to be used for the plaintiff's maintenance, support and benefit, supplemented by capital if necessary. The trustees had no warrant to apply less than the whole income and accumulate surplus as capital for remaindermen, because the will contained no accumulation clause and nothing indicating that less than all income was to be used for the plaintiff. However, the plaintiff was not entitled to receive the money outright; the trustees had a limited discretion as to the time and manner of applying it for his benefit, and they had not yet exercised that discretion.
